What the certificate certifies
An occupancy certificate is issued by the local authority — BBMP, the Greater Bengaluru Authority or BDA depending on jurisdiction — and states that a completed building matches the plan that was sanctioned for it and is fit for people to live in.
It is the final step in a sequence, not a formality at the end of it. The authority issues it after being satisfied that the required clearances are in place, which typically include fire safety, structural stability, lift and electrical safety, and water and sanitation approvals.

What happens to a buyer with no OC
- A-Khata is generally not issued for a building without a valid OC, which pushes the property onto the B register with everything that follows from it.
- Banks and housing finance companies commonly require OC before releasing final loan disbursement, which can leave a buyer bridging the gap themselves.
- Permanent electricity and water connections normally require it; buildings without OC sometimes run on temporary connections at higher tariffs.
- Occupying a building without OC is a municipal-law violation, and the corporation retains enforcement options against the building.
- Resale becomes materially harder, because the next buyer's bank will ask the same question yours did.
Why buildings do not get one
The commonest cause is deviation: the building as constructed differs from the plan that was sanctioned. Extra floors, reduced setbacks, converted common areas and changed layouts are all deviations, and they are physical facts rather than paperwork problems.
That is the crucial distinction for a buyer. A delay caused by an outstanding clearance usually resolves. A deviation may require the building itself to change before an OC can issue, and there is no guarantee that ever happens.
What to do before you take possession
- Ask for the OC in writing and get a copy. "Applied for" and "expected shortly" are not the same as issued, and both are common answers.
- If it has not been issued, ask specifically what is outstanding — a pending clearance and a plan deviation are very different risks.
- Compare the building as constructed against the sanctioned plan: floor count, setbacks, common areas and your unit's layout.
- Get the position recorded in writing before signing the possession letter, while it is still a condition rather than a complaint.
- Check the Khata classification, which will usually reflect the OC position.
Where an inspection helps
An inspection cannot issue an OC or speed one up. What it can do is establish, independently and on a specific date, whether the building matches what was sanctioned — the fact that determines whether the certificate is coming.
That turns a builder's assurance into something checkable, and it is far more useful before you sign possession than after.
